This Agreement is between Metro Sports and you, as an authorized user of Metro Sports products and services, and governs the terms and conditions of your use of Metro Sports products and services (“Terms of Use”). This Agreement, together with any operating rules, policies, price schedules, or other supplemental documents expressly incorporated herein by reference and published from time to time by Metro Sports (collectively, the “Agreement”), constitutes the entire agreement between Metro Sports and you regarding Metro Sports Products and Services,

By using a Metro Sports Product (defined below), you agree to these terms and conditions (“Terms of Use”) and the Metro Sports Privacy Policy. You agree to accept notices electronically.

DEFINITION OF TERMS

• Metro Sports is referred to herein as ” Metro Sports ” “we,” “us,” or “our.”
• You, as the user, are referred to herein as “you,” “user,” “subscriber,” “client,” or “customer.”
• Metro Sports Products. For purposes of these Terms of Use, the term ” Metro Sports Products” shall mean equipment, food supplements, sports goods & accessories, and all other items, features, websites, and services provided by Metro Sports.

MODIFICATIONS TO THE TERMS OF USE

Metro Sports may change the Terms of Use at any time, without notice to you, and at its sole discretion. The modified Terms of Use will be effective immediately upon posting on our website.

REQUIREMENTS FOR USE OF METRO SPORTS PRODUCTS

The Metro Sports Products are intended for general consumer use. You represent and warrant that you have adequate legal capacity to enter into binding agreements such as these Terms of Use. Metro Sports Products may require the user to register and provide certain personal information to Metro Sports, such as name, e-mail address, and billing address (the “Personal Information”). If you order any Metro Sports Products, you agree to provide accurate and complete Personal Information.

ASSUMPTION OF RISK / LIMITATION OF LIABILITY

The Customer and each user of the equipment, supplements, sports goods & accessories are solely responsible for the proper use thereof. Improper use may result in personal injury. Metro Sports will not be liable for any direct, special, indirect, or consequential damages arising out of the improper use of the equipment. The purchase of any of these items signifies acceptance of all responsibility and liability of monitoring user\’s usage and liability of training at own risk. In no event will Metro Sports be liable for any special, punitive, indirect, or consequential damages (including lost profits) resulting from the use or loss of use of the item, even if it has been advised of the possibility of such damage; nor will Bodyline Sports \’s liability to Customer (under contract, tort or otherwise) exceed the amount paid by the Customer under this agreement for the relevant item.

CHANGES TO THE SERVICE

Metro Sports has the right at any time to change, modify, add discontinue, or retire any aspect or feature of the Metro Sports website. Metro Sports has no obligation to provide you with notice of any such changes.
